 Official Contest Rules and Regulations

  • NO PURCHASE NECESSARY: The Brock Both Sides of the Brain Photo Contest (the “Contest”) is sponsored by Brock University (the “Contest Sponsor”/“Brock”). The Contest starts at 12:00:00 AM on September 24, 2009 and closes at 11:59:59 PM on January 13, 2010 (the “Contest Period”). All times are Eastern Times.
  • ELIGIBILITY: To participate in the Contest, you must be a legal resident of Canada excluding the province of Quebec, be a member of Facebook at the time of at time of entry and the time of receiving a Prize.  Any member of Facebook can participate in this Application.  To be eligible to win the Contest you must show proof that you are a current secondary school student, a student currently enrolled at Brock, faculty or staff member at Brock, or alumni of Brock. See Section 8 for details. Employees of University Marketing and Communications or Recruitment and Liaison Services at Brock University and persons domiciled with such an employee, prize suppliers and promotional and advertising agencies and administrators, are ineligible to enter. 
  • HOW TO BECOME A FACEBOOK MEMBER: To enter the Contest you must first become a member of Facebook, which is a free registration. Visit www.facebook.com and click on the “sign up” button. The standard Facebook registration form will appear. Complete the standard Facebook registration and you will become a Facebook member. By becoming a Facebook member, you agree to comply with the terms of use of Facebook. Limit of one (1) Facebook account per person during the Contest Period.
  • ALREADY A FACEBOOK MEMBER & HOW TO DOWNLOAD APPLICATION: Now that you are a Facebook member, you must download the “Brock Both Sides of the Brain Photo Contest” application. Visit www.facebook.com and enter your email and password to enter the site. Click on the “applications” button located in the top left hand side of the screen (below the Search field). Next, click the “browse more applications” button and then type the words “Brock Both Sides of the Brain Photo Contest” in the search field to search for the application. Click on the “Brock Both Sides of the Brain Photo Contest” application and then click “add the application”. The application will be added to your Facebook page and you can now participate in the Contest (see rule 5).

HOW TO PARTICIPATE IN THE CONTEST:

  • Upload a Photo: In order to upload a photo (the “Submission”) and be eligible for the Grand Prize, you must be a member of Facebook and must download the “Brock Both Sides of the Brain Photo Contest” application (see rules 3 and 4). Log into your Facebook page and click on the “Brock Both Sides of the Brain Photo Contest” application and you will be directed to the Contest page. Complete the Contest entry form with your full name, email address, gender, whether you are a high school student / undergraduate student at Brock / undergraduate student at another institution / graduate student at Brock / graduate student at another institution / alumni / staff or other, and your projected start year for University. Upon doing so, click “Submit” and you will be directed to the entry screen. Next, upload a Submission (see rule 6) from your Facebook page or your computer and match with an icon (or upload your own) that best represents both sides of your brain by 11:59:59 PM on January 13, 2010 (the “Submission Closing Date”) to be eligible to receive a vote. For Submission format and content, see rules 7 and 8.
  • HOW TO UPLOAD A SUBMISSION: To upload a Submission, click on the “upload a photo” button found on the entry screen. Select a photo from your current Facebook account or your computer, select a supplied icon, or upload your own icon and click the “upload” button and your Submission or will be automatically uploaded. All entries and materials submitted to the Contest Sponsor in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of the Contest Sponsor upon submission, and Entry Materials will not be returned to any entrant.

 

  • PHOTO FORMAT AND CONTENT: Each submitted photo or icon:
  • must be submitted in one of the following file formats: .jpg, .gif or .png;
  • can be uploaded from your computer or Facebook account;
  • must be no more than 2 MB in file size;
  • must be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Contest Sponsor is suitable for all persons, including persons 13 years of age;
  • must not, in the sole and unfettered discretion of the Contest Sponsor, contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate content;
  • must not, in the sole discretion of the Contest Sponsor, contain any commercial content that promotes any product or service other than that of the Contest Sponsor;
  • may be submitted only once;
  • must not contain any copyrighted works (other than as owned by the Contest entrant) and,
  • must contain entirely original materials
  • Each Submission is subject to the approval of the Contest Sponsor and must satisfy all the requirements set out above and be submitted in accordance with these Official Rules to be posted for voting. The Contest Sponsor’s rulings are final and without appeal in all matters related to the posting of the Submission and the awarding of the prizes.

SELECTION PROCESS:

Grand Prizes: There will be a total of six (6) Grand Prizes:

  • Entries may be disqualified if they have fewer than 100 votes.
  • The one female entrant scheduled to graduate from high school in 2010 and the one male entrant scheduled to graduate high school in 2010 who have received the highest number of votes at the end of the Contest period will be eligible to win one of two MacBook Pros. If there is a tie for the Grand Prize, a random draw will be held among the top entrants having achieved the highest top score to determine the potential Grand Prize winner. Odds of winning the Grand Prize depend on having the highest number of votes by the end of the Contest period. The selected entrant will be contacted by email within ten (10) business days of the Contest Closing Date. If the selected entrant cannot be reached within ten (10) business days of the Contest Closing Date, the selected entrant will be disqualified and the entrant with the next highest number of votes will be selected until such time as contact is made by email with a selected entrant or there are no more eligible entries, whichever comes first. The Contest Sponsor will not be responsible for failed attempts to contact a selected entrant.
  • The current Brock student with the most votes at the end of the Contest period will be eligible to win a $500 tuition credit from Brock. If there is a tie for the Grand Prize, a random draw will be held among the top entrants having achieved the highest top score to determine the potential Grand Prize winner. Odds of winning the Grand Prize depend on having the highest number of votes by the end of the Contest period. The selected entrant will be contacted by email within ten (10) business days of the Contest Closing Date. If the selected entrant cannot be reached within ten (10) business days of the Contest Closing Date, the selected entrant will be disqualified and the entrant with the next highest number of votes will be selected until such time as contact is made by email with a selected entrant or there are no more eligible entries, whichever comes first. The Contest Sponsor will not be responsible for failed attempts to contact a selected entrant.
  • The Brock alumni with the most votes at the end of the Contest period will be eligible to win a Bose SoundDock system with accessories. If there is a tie for the Grand Prize, a random draw will be held among the top entrants having achieved the highest top score to determine the potential Grand Prize winner. Odds of winning the Grand Prize depend on having the highest number of votes by the end of the Contest period. The selected entrant will be contacted by email within ten (10) business days of the Contest Closing Date. If the selected entrant cannot be reached within ten (10) business days of the Contest Closing Date, the selected entrant will be disqualified and the entrant with the next highest number of votes will be selected until such time as contact is made by email with a selected entrant or there are no more eligible entries, whichever comes first. The Contest Sponsor will not be responsible for failed attempts to contact a selected entrant.
  • The one female entrant who is currently a Brock faculty or staff member and the one male entrant who is currently a Brock faculty or staff member who have received the highest number of votes at the end of the Contest period will be eligible to win one of two $250 Brock Campus Store gift cards. If there is a tie for the Grand Prize, a random draw will be held among the top entrants having achieved the highest top score to determine the potential Grand Prize winner. Odds of winning the Grand Prize depend on having the highest number of votes by the end of the Contest period. The selected entrant will be contacted by email within ten (10) business days of the Contest Closing Date. If the selected entrant cannot be reached within ten (10) business days of the Contest Closing Date, the selected entrant will be disqualified and the entrant with the next highest number of votes will be selected until such time as contact is made by email with a selected entrant or there are no more eligible entries, whichever comes first. The Contest Sponsor will not be responsible for failed attempts to contact a selected entrant.
  • In order to win and receive the grand prize, the selected entrant must first correctly answer, unaided, a mathematical skill-testing question asked at the time that is mutually convenient to the contest sponsor and the eligible grand prize winner.
  • PRIZES: There are a total of six (6) Prizes available to be won.
      • There will be two (2) MacBook Pros available to be won, retail value of approximately $2,000 each.
      • There will be a $500 tuition credit for Brock University available to be won.
      • There will be a Bose SoundDock system with accessories available to be won, retail value of approximately $500.
      • There will be two (2) $250 Brock Campus Store gift cards available to be won.

Prizes must be accepted as awarded without substitution and are not transferable, not for resale and have no cash surrender value. The Contest Sponsor reserves the right, in the event that a Prize or any component of the Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability. Limit of one (1) Grand Prize per person. No cash substitutes.

  • GENERAL: By entering the Contest, entrants agree to abide by the Official Rules and the decisions of the independent Contest organization with respect to all aspects of the Contest. The decisions and rulings by the independent Contest organization and/the Contest Sponsor are final and without appeal in all matters related to the posting of the photos and the awarding of the prizes. By entering and uploading a Submission in the Contest, each entrant agrees to assign all right, title and interest (including copyright) in and to the Submission entered to the Contest Sponsor and waive any and all moral rights in the Submission in favour of the Contest Sponsor. The Contest Sponsor may, in its sole discretion, elect to use, in whole or in part, any Submission entered into this promotion for its own future advertising and/or promotional activities, without notice or compensation; and that the person submitting same has no further copyright or similar claim. Each entrant warrants to the Contest Sponsor and its agents, parent, affiliated or related companies, subsidiaries, divisions, prize suppliers, the independent Contest organization, and promotional and advertising agencies and administrators that the submission does not contravene or infringe on anyone else’s copyright or other intellectual property. 
  • Each potential winner, or his/her parent or legal guardian if the selected entrant is not the age of majority, will be required to sign a declaration and release form (the “Release Form”) confirming compliance with the Official Rules, acceptance of a Prize as awarded, without substitution, and releasing the Contest Sponsor, its affiliated and related companies, advertising and promotional agencies, the independent Contest organization and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with a Prize or this Contest. The duly completed Release Form must be returned within the time period specified on the Release Form or the Prize will be forfeited. A selected entrant who is not at least of the age of majority will require his/her parent or legal guardian to act on his/her behalf in regards to accepting the prize. The delivery of each Prize will be arranged through the Sponsor within (30) days of receipt of the duly completed Release Form.
  • The Contest Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or any Prize associated with this Contest. By entering and accepting a Prize, the winner consents to the use of his/her name, address (city and province) and/or photograph without further remuneration, in connection with any publicity carried out by or on behalf of the Contest Sponsor with respect to this Contest. 
  • All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsor. The Contest Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. The Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of the Contest Sponsor and will not be returned
  • The Contest Sponsor assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. The Contest Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest, or any portion thereof, should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 
  • Brock is collecting personal data about entrants for the purpose of administering this Contest. No further information or marketing communications will be received by entrants unless entrants provide Brock with explicit permission to do so as indicated on the Official Entry Form.   • The Contest Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, such as tampering or infection by computer virus, the Contest Sponsor reserves the right to cancel the Contest and conduct the draw from all previously received eligible entries received by the Contest Closing Date. The Contest Sponsor and the independent Contest organization shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest including but not limited, to any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of the entrant’s participation in this Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. An entrant may be required to provide proof of being the holder of the Facebook account associated with the winning entry. 
  • All entries become the permanent property of the Contest Sponsor and none will be returned. No correspondence will be entered into except with the selected entrants.
  • This Contest is subject to all applicable Canadian federal, provincial and municipal laws. 
  • If the identity of an entrant is disputed, the Facebook account holder submitted at the time of entry will be deemed to be the entrant. The individual assigned to the Facebook account is considered the authorized account holder. A selected entrant may be required to provide proof of being the Facebook account holder associated with the selected entry. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine.
  • Contest is open to all residents of Canada excluding Quebec. 
  • Brock will be excluding content that is (1) Denigrates Brock or its competitors’ lines of businesses; (2) Off topics or irrelevant to the purpose of the Contest; (3) Use of profane actions or language violating any Canadian laws.
  • Submissions that do not meet the criteria above will be removed, and the submitter may not be contacted.
