The Opportunity

Reporting to Vice-President, Research, the Legal Advisor and Contracts Officer provides the Vice-President, Research and the Office of Research Services with effective legal counsel and advice, direction, and representation on legal matters related to research, intellectual property, technology transfer and contracts for members of the Brock University research community.

Duties and Responsibilities

• Reviewing and providing legal and policy advice on a variety of issues including research contracts, research grants, non-disclosure agreement, licenses for intellectual property, international agreements, and other contracts and agreements into which the University proposes to enter for research and other related purposes
• Working with other Research Officers to create new funding opportunities
• Navigating legal issues, identifying legal risks and negotiating legal aspects of research agreements and contracts and general contract matters
• Reviewing, assessing and making recommendations regarding Brock University policies and procedures on research and other related matters
• Analyzing and assessing legal risk to Brock University, as it relates to research and other general matters
• Analyzing, reviewing and advising on internal disputes and/or disputes with third party sponsors
• Reviewing and developing Research Contracts and Agreements in accordance with all applicable policies, practices, legislation, and other related guidelines, proactively reviewing contracts and agreements as well as providing advice, drafting policies and developing templates and procedures relating to legal and associated research matters
• Drafting research and related agreements, intellectual property contracts and patent applications for review by senior administration, faculty members and sponsors
• Providing legal advice on the structure and language of research agreements and contracts
• Drafting agreements and contracts, when no acceptable template or precedent exists
• Assisting with and advise on all matters related to intellectual property, and performing necessary duties related to the protection of copyright, trademarks and patents
• Providing education, training, and information to faculty members, staff and students on legal issues related to grants and contract matters, research, and intellectual property
• All other related duties as required and assigned by the Vice President Research

The ideal candidate will have:

• Undergraduate degree as well as Bachelor of Law or equivalent
• A member in good standing with the Law Society of Upper Canada
• A minimum of 3-5 years of experience in the management of legal affairs, preferably within a university environment
• Familiarity with university issues, culture and organization
• Practice expertise within an appropriate field (post-secondary research contract review, administrative law) and applied knowledge of appropriate legislation and experience dealing with related issues
• Demonstrated legal research and negotiating skills with the ability to take independent initiative and to work collaboratively with others (faculty members, professional staff and/or students)
• Analytical and critical thinking skills
• Proven leadership and management skills; ability to identify and distill applicable legal issues and principles to given fact situations and questions
• Excellent oral and written communication skills with ability to present legal opinions and arguments, discuss law and procedures in plain language and ability to draft legal instruments
• Ability to work under pressure and respond to competing demands and changing/conflicting priorities
• Proficiency with various computer programs, including Word Processing, Internet etc.
• The ability to exercise judgment, tact diplomacy and confidentiality (especially when managing issues between the University and its faculty members, staff and/or students)
